Brincatoys Cashback Program
The Customer Loyalty Program, hereinafter referred to as the “Brincatoys Cashback Program”, is promoted and organized by Brincadeiras ao Cubo, Comércio de Jogos e Brinquedos, Lda., headquartered at Marina Plaza, Edifício Daytona Beach, Block 27-A, Store 79, Vilamoura, 8125-401 Quarteira, Taxpayer number: 510204538, and is subject to the General Conditions, which define the operating conditions of the “Brincatoys Cashback Program”, which constitute this document, hereinafter referred to as the “General Conditions of the Brincatoys Cashback Program”.
The “Brincatoys Cashback Program” is exclusively intended for customers who meet the requirements established in the General Conditions and who join it in accordance with the provisions of this program, (hereinafter referred to as “Member”).
Joining the “Brincatoys Cashback Program” implies full and unconditional acceptance, by the Member, of these General Conditions, binding Brincadeiras ao Cubo, Lda., under the terms of these general conditions.
The non-application by Brincadeiras ao Cubo, Lda. of any of these General Conditions does not imply a waiver of the right to demand compliance with any of these conditions.
The application of the “Brincatoys Cashback Program” is limited to the online store, at Brincatoys (hereinafter, "Website").
The Brincatoys Cashback program allows accumulating 4% of the amount spent on product purchases by the Member/customer and provides the obtaining of benefits.
I. JOINING THE BRINCATOYS CASHBACK PROGRAM
a) Joining the Brincatoys Cashback Program by the member will be done through registration as a customer in our online store, located at www.brincatoys.pt, brincatoys.com or brincatoys.es, which will grant the customer the right to become a participant in it, in accordance with the provisions of these General Conditions.
b) Brincatoys will process the customer's data requested in the registration application, in accordance with the provisions of Law 58/2019 of August 8 regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data, the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016), and any implementing regulations in force or to come into force, stipulated in these General Conditions.
c) In any case, the correct and complete communication of the data identified as mandatory in the "Customer Registration" is an essential requirement for the registered customer/member to have the right to participate in the Brincatoys Cashback program, so its non-entry or incorrect, illegible, or incomplete entry will result in the Registered Customer not participating in the said program.
d) The Member is responsible for keeping their personal data updated on www.brincatoys.pt, brincatoys.com or brincatoys.es. Brincatoys is not responsible in cases where the Member does not receive their offers and/or communications due to incorrect or outdated data.
II. BRINCAToYS CASHBACK PROGRAM
a) The Brincatoys Cashback Program is based on the accumulation and redemption of balance/credit generated through purchases made by customers on our website (brincatoys.pt; brincatoys.com or brincatoys.es.
b) The credit value calculated will be accumulated in the Member's account or profile on the Website, with the aim of enjoying benefits on product purchases available at www.brincatoys.pt, brincatoys.com or brincatoys.es.
c) Brincatoys reserves the right to verify the Member's identity for any circumstance related to the Brincatoys Cashback Program (i.e., making purchases, returning, accumulating and redeeming points, enjoying associated benefits, etc.).
III. OBTAINING CASHBACK
Once registered in the Brincatoys Cashback Program, each Member can accumulate credit value related to cashback as follows:

For every €1 of product purchases made in our online store, you will receive 4% of your purchase excluding shipping. Each euro spent equals €0.04 in credit (4% of your purchase excluding shipping). For example: if you purchase a product worth €13.99 you will receive €0.52 in credit (€13 x 4% = €0.52).
The cashback credit value cannot be assigned or exchanged for money or its cash equivalent, nor transferred to third parties.
IV. BENEFITS OF THE BRINCAToYS CASHBACK PROGRAM
With the Brincatoys Cashback Program, all your purchases will be rewarded. This program allows registered customers to accumulate value in euros/cents with these purchases, giving you access to the following benefits:
a) For every €1 spent on product purchases made in the online store, you will accumulate 4% of your purchase in credit. The refund is calculated excluding taxes and shipping costs (when applicable).
b) The value of the cashback credit, resulting from your last purchase in the online store, will be made available in the account associated with the registered customer after the completion/finalization of the order payment process.
c) Throughout the year, we offer discounts linked to different promotions.
d) Cashback credit accumulation will be done in whole numbers, rounded down (example: for an order worth €10.99, €0.40 in cashback credit will be awarded).
h) In case of using cashback credit redemption/discount on a purchase, the number of cashback credits awarded for that purchase will take into account the resulting value of the difference between the total order, excluding shipping, and the value of the redemption/discount applied.
V. REDEMPTION OF ACCUMULATED CASHBACK CREDIT
a) Credits from the Brincatoys Cashback Program, earned by customers, will be accumulated in the Registered Customer's balance after the customer's purchase payment and can only be redeemed/used by registered customers for future purchases at brincatoys.pt ;www.brincatoys.com; or www.brincatoys.es.
b) You can use your credits in the online store, after they have been credited to your account, for a purchase of products of any value, provided, however, that the value of the product to be purchased is higher than the value of the credits redeemed/used in the purchase.
c) The discount resulting from the redemption/use of credits is applied to the total value of the products purchased through the order and does not cover shipping costs (Carriage).
d) Credits can be combined with other direct discount promotions.
e) Credit redemption will be done in whole numbers and with a minimum of €1.00, through conversion to be used in the store's shopping cart.
f) You can use your credits in the online store, after they have been credited to your account, for a purchase of products of any value, provided, however, that the value of the product to be purchased is higher than the value of the credits redeemed/used in the purchase.
g) When this happens, the redeemed/used credits will be removed from the existing balance in the registered customer's account.
h) In situations where the customer redeemed credits, if payment is not made within the stipulated deadline, the purchase will be canceled and the credit will be credited back to the customer's account balance.
i) Points cannot be awarded or exchanged for money or their cash value.
VI. CASHBACK BALANCE VALIDITY CANCELLATION OF THE LOYALTY PROGRAM
a) Credits obtained through purchases made by the registered customer will be valid for three hundred sixty-five (365) days from the date of acquisition of the first order in which the credits were generated, renewing this date whenever the customer makes a new purchase or redeems credits.
b) The registered customer will be notified of the expiration of credits by email thirty (30) days in advance of the expiration date.
c) If the customer decides to cancel their registration as a customer, they only need to send an email to geral@brincatoys.pt, requesting the cancellation of their registration. This cancellation process may take up to 72 hours.
d) Once the cancellation is effected, the credits accumulated with the Brincatoys Cashback Program, up to that date, will disappear and cannot be recovered.
VII. PRODUCT RETURNS
a) In case of product returns, the cashback credit value will be deducted or refunded, as the case may be, according to the following:
• (i) Full refund: If a Member returns all the products purchased in a purchase, the entire cashback credit value that was accumulated or redeemed in that purchase will be deducted.
(• (ii) Partial refund: in case a Member returns part of the products purchased in a purchase, the cashback credit value that was accumulated or redeemed in that purchase, if any, will be deducted on a proportional basis, based on the price of the product to be returned
b) The cashback value deductions will be made within 72 hours after the refund confirmation. Therefore, 72 hours after the refund confirmation, the Member's balance should be updated with the cashback credit balance held by the Member.
VIII. POINTS CHECK AND COMMUNICATIONS
a) The Member can check the available cashback credit balance at www.brincatoys.pt, brincatoys.com or brincatoys.es, in the customer area.
b) Brincatoys will send its electronic communications related to the Cashback Program by email to the email address provided by the member at the time of joining the Brincatoys Cashback Program.
IX. PERSONAL DATA PROCESSING
Information about the processing of customers' personal data can be found in the Privacy Policy.
X. MODIFICATION AND CANCELLATION OF THE GENERAL CONDITIONS
a) Brincatoys reserves the right to unilaterally modify the General Conditions. Notwithstanding the foregoing, the latest version of the General Conditions applicable to the Brincatoys Cashback program will be available at brincatoys.pt, brincatoys.com and brincatoys.es.
b) Brincatoys also reserves the right to modify, suspend or cancel the Cashback program, in which case members will be informed through the site brincatoys.pt, brincatoys.com and brincatoys.es.
c) In case of cancellation of the Brincatoys Points Program, Members will have a maximum period of 30 days to redeem the points accumulated up to that date, otherwise, these points will be lost.
c) In case of cancellation of the Brincatoys Cashback Program, Members will have a maximum period of 30 days to redeem the cashback balance accumulated up to that date, otherwise, that cashback balance will be lost.
d) In case of force majeure, the Brincatoys Cashback Program may be suspended or canceled without prior notice to Members.
XI. LIABILITY
a) The modification or cancellation of the Cashback Program by Brincatoys shall not entitle the Member to any type of compensation.
b) Participation in the Brincatoys Cashback Program requires compliance with the General Conditions. Consequently, Brincatoys reserves the right to cancel the advantages or benefits associated if a Registered Customer engages in any conduct that implies a violation of these General Conditions. In any case, Brincatoys will terminate the Cashback Program of the Member without prior notice and by the most convenient means, without the registered customer being entitled to any compensation, in the following cases:
(i) in case of fraud or attempted fraud in the store by the Registered Customer;
(ii) in case of improper use of the Cashback Program;
(iii) in the case of actions aimed at altering the proper functioning of the Cashback Program.
c) Brincatoys shall not be responsible for consequences caused by lack of communication with the Registered Customer when such lack of communication is due to a malfunction of the email address or the inaccuracy of the information provided by the customer.
d) Brincatoys cannot guarantee the availability and continuous operation of the Cashback Program, particularly when there is a technical malfunction of computer systems, servers, computer equipment, Internet malfunction, data destruction due to hacking or error, or any other technical problem.
e) Whenever reasonably possible, Brincatoys will notify the Registered Customer of any interruptions in the operation of the Cashback Program. In this regard, Brincatoys assumes no liability for any damages of any kind that may arise due to the lack of availability or continuity of the Cashback Program's operation.
XII. Jurisdiction and Applicable Law.
a) The use of our website and consumer disputes related to the Cashback Program shall be governed by Portuguese law, and the customer may resort to a territorially competent dispute resolution Entity considering that the transactions carried out through it are deemed to be concluded in the seller's headquarters area.
b) The resolution of any type of controversy, dispute or discrepancy that may arise between the Customer and the seller, regarding the interpretation, application and execution of these general conditions, shall be submitted to the court of the District of Faro, with express waiver of any other.
c) Without prejudice to the rights arising from Portuguese Law, during their commercial relations, the parties undertake to try to find solutions for any conflict that arises in a spirit of good faith and cooperation.
XIII. ENTRY INTO FORCE
These General Conditions come into effect on January 1, 2024.
